Description and learning points:

A due process hearing before an Impartial Hearing Officer is one option to address conflicts that may arise between parents and school districts in special education. Because it is a formal, legally binding, and time-consuming process, it is essential to understand when and why a due process hearing is the right option. Participants will gain a practical understanding of due process from a panel that includes an experienced special education Impartial Hearing Officer, student/parent attorney, and a school attorney. Participants will learn:

 

  • What is a due process hearing
  • What types of disputes can due process hearings resolve
  • What types of remedies are available through due process hearings
  • Important considerations when deciding to use a due process hearing
  • Overview of due process procedures and requirements, including the resolution process
  • Whether parents should consider legal representation
  • Overview of alternatives to due process hearings to resolve special education disputes
